What happened?
In order to ensure that cherries treated with Phosmet, an active substance whose consumption is likely to constitute a serious risk to human health, are not offered to French consumers, the import, introduction and placing on the market in France of fresh cherries originating in countries outside the European Union have been prohibited by order of 16 March 2023 (JORF n°72 of 23 March 2023)
What does it mean?
The Notice to Importers of 16 June 2023 (JORF No. 138) specified that all third countries, except the United Kingdom, were affected by these measures. (see previous post) A new notice to importers of 10 August 2023 (JORF n°65) repeals the previous one and specifies that from now on, the import is prohibited in France:
- For sour cherries, originating in countries outside the EU excluding the United Kingdom and
- For other cherries, originating in countries outside the EU excluding the United Kingdom and Canada.
What must I do if I import cherries into France as customs declarants?
Nomenclature 08 09 21 00 – Sour cherries – Prohibited imports into France from third countries except the United Kingdom
Nomenclature 08 09 29 00 – Other cherries – Prohibited imports into France from third countries except the United Kingdom and Canada.
It should be noted that fresh cherries from organic production in accordance with the provisions of European Regulation EU 2018/841 are excluded from this system.

Afin que les cerises traitées au Phosmet, une substance active dont la consommation est susceptible de constituer un risque sérieux pour la santé humaine, ne soient pas proposées aux consommateurs français, l’importation, l’introduction et la mise sur le marché en France de cerises fraîches originaires de pays tiers à l’Union européenne ont été interdites par arrêté du 16 mars 2023 (JORF n°72 du 23 mars 2023)
L’avis aux importateurs du 16 juin 2023 (JORF n°138) précisait que tous les pays tiers, sauf le Royaume-Uni, étaient concernés par ces mesures. (voir post précédent)
Un nouvel avis aux importateurs du 10 août 2023 (JORF n°65) abroge le précédent et précise que désormais, l’importation est interdite en France :
- Pour les cerises acides, originaires de pays tiers à l’U.E à l’exclusion du Royaume-Uni
et
- Pour les autres cerises, originaires de pays tiers à l’U.E à l’exclusion du Royaume-Uni et du Canada.
En résumé, pour les déclarants en douane :
Nomenclature 08 09 21 00 – Cerises acides- Importation en France interdite de pays tiers à l’exception du Royaume-Uni
Nomenclature 08 09 29 00 – Autres cerises – Importation en France interdite de pays tiers à l’exception du Royaume-Uni et du Canada.
A noter que sont exclues de ce dispositif les cerises fraîches issues d’une production biologique conforme aux dispositions du règlement européen UE 2018/841
