The DGEC hosted a CBAM (Carbon Border Adjustment Mechanism) webinar on Wednesday, 16 October 2024, to review the first three reporting periods, clarify CBAM application during the transition phase, mainly when real emissions data is unavailable, and introduce the "Authorised CBAM Declarant" status for the definitive period starting on January 1, 2026.
Here is our 5-point summary of the operational aspects from the DGEC’s 16 October 2024 webinar. This summary is not a substitute for the entire webinar, which is available in the links at the end.
1. When Real Data is Unavailable for Reporting
As of Q3 2024, the “Default Values” option has been removed from the CBAM Register. To address challenges in gathering real data, the Commission has introduced the “Actual Data Not Available” option.
To activate this option:
Go to “Add Emission” → enter net mass in tonnes → for direct and indirect emissions, select “Actual Data Not Available” in “Type of Determination.”
Fields will auto-fill with zero values.
Missing supplier names in the "Operators/Installations" fields won’t prevent submission.
Provide justification in “Additional Information,” and, in the “Supplementary Information” tab, upload exchanges with suppliers that demonstrate data collection efforts.
Confirm the line; an orange warning will appear, which does not block submission. Once ready, save and click “Submit.”
2. Changes to French Guidelines on Default Values and New Thresholds (September 2024 DGEC Note)
The French proposal allowing default values for Q3 and Q4-2024 if real data is unavailable is no longer valid due to the updated CBAM Register requirements. The Commission prefers the solution outlined in point 1, which identifies importers facing challenges while still tracking imported tonnes.
Note: As per the Declarant Manual (8 October 2024, p. 61), this option has no set deadline. Meanwhile, France continues to focus on imports with over 100 tCO2eq per quarter, adding a quantitative threshold of 1 tCO2eq per shipment (in addition to the €150 exemption threshold), under which reporting may be waived.
The DGEC and DGDDI recommend that importers with available resources declare all shipments.
3. Estimating tCO2eq Emissions for French Threshold Calculations
To assess whether imports meet these thresholds, the DGEC recommends using default values (direct and indirect emission rates combined and multiplied by imported tonnage). The Commission has published a default values Excel file.
4. Temporary Nature of these Flexibilities
The Commission and DGEC expect importers to continue collecting real emissions' data from suppliers. Over time, reports anticipate fewer zero-value entries.
5. "Authorised CBAM Declarant" Status for 2026 Imports
Starting January 1, 2026, "Authorised CBAM Declarant" status will be mandatory to import CBAM products and purchase corresponding CBAM certificates.
Preparation: From January 1, 2025, gather the required documentation to apply for "Authorised CBAM Declarant" status when the platform opens. The required documents list is provided in the webinar (at 1h13min).
The DGEC encourages questions, feedback, and comments via the CBAM functional mailbox. While responses to every message are not guaranteed, the information gathered will inform regulatory and tool updates.
