Which countries now require authorisations for non-listed items?
Under Article 4(3) of the Regulation, several Member States have implemented "catch-all" controls for dual-use items not specifically listed in Annex I. Exporters must obtain authorisation if they suspect items are intended for prohibited uses, such as chemical or biological weapons programs.
As of May 2026, the following countries have confirmed these national legislation requirements:
Belgium: Required in both Flemish and Walloon Regions.
Bulgaria: Mandatory under the Defence-Related Products and Dual-Use Items Act.
Ireland: Enforced via the Control of Exports Act 2023.
Italy: Governed by Legislative Decree n° 221/2017.
Others: Bulgaria, Czech Republic, Denmark, Croatia, Latvia, Lithuania, Luxembourg, Hungary, Austria, Romania, Slovenia, Finland, and Sweden.
What are the penalties for dual-use violations?
The 2026 update provides a grim (but necessary) look at the consequences of getting it wrong. Penalties vary significantly by Member State, ranging from hefty fines to significant jail time.

How does this affect brokering and technical assistance?
The EU is tightening the net on services, not just physical goods. Many Member States have extended brokering controls (Article 6) and technical assistance controls (Article 8) to non-listed items.
For instance, in Bulgaria, brokering authorisation is now required for non-listed items if intended for military end-uses. Similarly, in the Flemish Region of Belgium, technical assistance for non-listed items requires a license if the provider is informed of potential prohibited end-uses. This "service-based" control means that even if you aren't shipping a box, you might still be breaking the law by sharing your expertise or facilitating a deal.
