How do I start a classification under Rule 1?
Classification is not a guessing game; it is a legal process. Rule 1 dictates that you must classify goods according to the Terms of the Headings and any relevant Section or Chapter Notes. In roughly 90% of cases, Rule 1 settles the matter. If the heading says "Live Horse" and you have a live horse, you are done. You don't need to overcomplicate things unless the text itself doesn't provide a clear answer.
What happens if the product is unfinished or mixed?
When Rule 1 fails, we look at Rule 2. This rule allows you to classify an incomplete or unfinished article as if it were complete, provided it has the essential character of the finished product.
For example, a "knocked-down" bicycle frame (Rule 2a) is still a bicycle. Rule 2b covers mixtures. If you have a ceramic pot with a metal stand, and Rule 2 cannot decide the outcome, you must move to the "tie-breaker" rules in Rule 3.
How do I choose between multiple headings?
If your product seems to fit in two places—like a "Smart Watch" which is both a radio-transmitter and a timepiece—Rule 3 provides the hierarchy:
Rule | Method | Application |
3(a) | Most Specific Description | Choose the heading that describes the item most precisely. |
3(b) | Essential Character | Classify based on the material that gives the product its "soul." |
3(c) | Last in Numerical Order | If (a) and (b) fail, choose the heading that appears last in the tariff. |
What are the "Most Akin" and "Packaging" rules?
Rule 4 is the "Hail Mary" of classification; if no other rule works, you classify the item under the heading for the goods to which it is most akin. In 2026, this is rare but useful for brand-new inventions.
Rule 5 handles the "extras." Rule 5(a) ensures that a violin case is classified with the violin, while Rule 5(b) covers standard packing materials like cardboard boxes. Finally, Rule 6 ensures that the same logic used for 4-digit headings is applied to 6-digit subheadings to ensure global uniformity.
Why should you care about German-style precision?
The German customs authorities (Zoll) are legendary for their love of detail. If you think "close enough" is a valid classification strategy, prepare for a very expensive letter. Using the GIR correctly isn't just a "nice to have"—it’s your legal defense against accusations of misdeclaration. Don't let a simple drone-camera classification turn into a multi-year legal battle because you skipped Rule 3(b).
