🔓 Major U.S. customs changes: New EO 14411 enforcement, forced labor tariffs on 60 nations, and 100% pharma duties start now.
U.S. Import Compliance Update 2026 - Core Regulatory Shifts
The United States has implemented three major trade actions in 2026. Executive Order 14411 forces strict importer vetting and bonding requirements. The USTR has applied Section 301 tariffs on 60 economies regarding forced labor. New Section 232 duties of up to 100 percent now target specific patented pharmaceutical products. These initiatives require importers to overhaul compliance programs, reassess corporate entity structures, and monitor rapid policy updates across global supply chains.
How Does Executive Order 14411 Change Importing?
Executive Order 14411 requires you to maintain good standing with Customs and Border Protection. You must provide detailed beneficial ownership data, business affiliations, and domestic asset disclosures. Foreign importers face a ban on informal entries for low-value goods. You must now meet a higher minimum bond coverage and prove compliance history to retain your status. U.S. authorities intend to close loopholes that allowed bad actors to evade duties through shell companies and complex corporate structures.

Which Economies Face Section 301 Forced Labor Tariffs?
Sixty nations face additional duties for failing to enforce bans on forced labor. Duties took effect on July 24, 2026.
Tariff Rate | Key Economies Impacted |
10 Percent | Canada, Mexico, UK, India, Bangladesh, Malaysia |
12.5 Percent | All other non-compliant investigated nations |
MFN-Net Cap | EU, Japan, Korea, Switzerland, Taiwan |
The Office of the United States Trade Representative concluded that widespread failure to prohibit forced labor imports imposes an unreasonable burden on United States commerce. Importers must review supply chains to verify the provenance of raw materials and finished goods.
What Must Pharma Importers Know About Section 232 Duties?
A 100 percent duty rate applies to many patented pharmaceuticals and active ingredients. Enforcement began on July 31, 2026, for designated companies and starts on September 29, 2026, for others. Generic drugs, biosimilars, and orphan drugs currently maintain an exemption. You qualify for a 20 percent rate if you hold an approved onshoring plan. These measures address national security vulnerabilities arising from heavy reliance on foreign active pharmaceutical ingredients.

✔ CBP Form 28 – Request for Information
✔ CBP Form 29 – Notice of Action
✔ Information that CBP might request
✔ The involvement of classification, valuation, and origin
✔ The significance of accurate customs records and supporting documents.
