EU Sanctions Update: Combatting ISIL (Da’esh) and Al-Qaeda Threat

Background

The EU, on September 20, 2016, adopted restrictive measures against the terrorist organizations, ISIL/Da'esh, Al-Qaeda, as well as legal and natural persons, groups, undertakings, and entities that are associated with them. These measures were put in place to combat the threat posed by these terrorist groups to the European Union and its member states.

Since then, the EU has been able to autonomously adopt restrictive measures against these groups and associated parties without any external influence. This has helped the EU to take swift action against any threat posed by these terrorist groups.

On September 20, 2023, the High Representative of the Union for Foreign Affairs and Security Policy submitted a proposal to extend the restrictive measures for another 12 months. This proposal was made to continue the fight against terrorism and keep the citizens of the EU safe from any potential threat.

The UN resolutions are given effect in Union law by means of Common Position 2002/402/CFSP (2) concerning restrictive measures against members of the ISIL (Da'esh) and Al-Qaeda organisations, and other individuals, groups, undertakings and entities associated with them and by Council Regulation (EC) No 881/2002.

The regime allows the EU to impose targeted restrictive measures on those who perpetrate terrorist acts, provide support to and incite such acts or recruit for ISIL/Da’esh and Al-Qaeda or their affiliates. Currently, six individuals are subject to restrictive measures, which consist of a travel ban to the EU and an asset freeze. In addition, EU persons and entities are forbidden from making funds and economic resources available to those listed. These autonomous restrictive measures are complementary to sanctions imposed by the UN Security Council against ISIL/Da'esh and Al-Qaida.

ISIL/Da'esh and Al-Qaeda: EU restrictive measures prolonged for an additional year

The Council adopted today a decision prolonging existing restrictive measures against ISIL/Da'esh, Al-Qaeda and natural and legal persons, groups, undertakings, and entities associated with them for a further year until 31 October 2024.

Currently, the sanction regime in place applies to 14 persons and 5 groups. Those targeted are subject to an asset freeze and a travel ban to the EU. Additionally, EU individuals and entities are forbidden from making funds, financial assets or economic resources available to those listed under the sanction regime.

These autonomous restrictive measures are complementary to those imposed by the UN Security Council against ISIL/Da’esh and Al-Qaeda.

The EU remains committed to acting against those who threaten international peace and security by planning, financing, and executing terrorist attacks and spreading terrorist propaganda globally.

The decision will enter into force on the day following its publication in the Official Journal of the European Union.
