Hello Customs Professional,

I am so glad you're reading this update on the recent developments in customs law, policy, and guidance in the EU, UK, and U.S. from last week.


I have designed this update to help you navigate customs by tracking over thirty topics that customs professionals need to know about, from A for Anti-Dumping Duty to W for World Trade Organisation (WTO). Reading the articles of "The Customs Manager" when you get to the office or commute to work lets you focus on other essential tasks, while we ensure you stay informed of all the latest updates. Typically, just ten minutes is all it takes to go over this update and decide if further investigation is necessary.


So what can you expect from this week's edition?


All eyes are now on Abu Dhabi for the WTO's MC 13:


We look at the multilateral Moratorium on Customs Duties on Electronic Transmissions, which aims to prevent the imposition of customs duty on "goods" exchanged internationally in electronic transmissions. International partnerships are pushing for the extension of this temporary suspension - and I am a strong supporter of the extension. What about you?. WE explore this further in this edition of The Customs Manager as global alliances are formed to preserve it.


Recently, WTO DG Okonjo-Iweala acknowledged the challenges members are encountering in securing a set of outcomes for MC13, but expressed confidence in members' ability to deliver. This edition of the Customs Manager allows you to dive into WTO MC13 topics like fisheries subsidies, reforming dispute resolution, and extending the e-commerce embargo. Have you followed Indonesia's WTO case against the import duties on fatty acids imposed by the EU?


Now focusing on the WCO - the organisation has also been quite engaged. They have recently released new class decisions, updated their Classification opinions, and explanatory notes. This information is valuable for individuals working in customs, as it covers a variety of products that have been classified, including newer ones. We address this in the latest edition of The Customs Manager, and you can download the WCO classification documents immediately.


As always, we cover all the policy, law, and guidance changes of the EU, UK and the U.S. - noe of which any customs manager can afford to miss.


Specifically, in this edition, we discuss the EU's anti-dumping duty on ceramic tiles from China and the two new custom classifications on hair colour swatch books and projectors with tuners. The UK has also implemented tariff changes, which you can find in this edition.


You can quickly access the latest UCC amendments proposed by the European Parliament in the draft Union Customs Code report available for download from our edition.


The UK Government has unveiled an agreement to revive the Northern Ireland Assembly and Executive, which have been experiencing limited functionality since February 2022. The agreement was released in a Command Paper named 'Safeguarding the Union'. Let's have a closer look at the updated Windsor Framework and its implications for retailers bringing products to Great Britain without an EU label. Discover the latest proposals for the 'UK Internal Market Lane' as an alternative to the current "green lane" for goods moving into Northern Ireland from Great Britain.

WCO published new classifications decisions, opinion and explanatory notes


Why it matters ⇒ I have read with great interest that the WCO has recently implemented a new list of Customs Options, revised Explanation Notes, and issued a Classification Decision. I find it fascinating to examine these, as they provide valuable guidance on categorising unique and innovative products. Includes numerous images. Extremely informative and essential for all classification specialists.


What has been classified?


The revisions classify cannabis extract, food supplements, and liquid food preparations, ornamental plastic penguin family, a dental dam made of vulcanised non-cellular rubber, smartphone display cover glass made of tempered safety glass, and an electronic device with HDMI, two USB, Ethernet, a memory card reader, and an operating system.


Electric car lighting, traffic and speed enforcement lasers, battery-operated running watches, window decorations, conservatories, and robotic toys are also examples. of what's been classified.

EU TARIC updates

The EU TARIC gets updated multiple times a week, The changes should be reviewed by the customs manager to ensure that their businesses are not affected. IT content providers also require this data for their customs management solutions. The TARIC is an extensive database that consolidates all the necessary information on EU customs tariffs, commercial, and agricultural legislation. The updates are provided in Excel form, too.


New EU Classifications: Hair colour swatch book and projector with tuner

Why it matters ⇒ The EU is about to publish two new classifications on a hair colour swatch book and projector with tuner. These rulings are an important opportunity for customs professionals to learn about the Classification mythology of customs authorities and should be studied.

UK adds missing tariff rates

Due to a missing tariff dataset entry in respect of 103 – Third Country Duty measures for Erga Omnes (Geographical area ID 1011) the duty rate has been updated for certain commodity codes. Details here.

Harmonized System Update (HSU) 2403

Why it matters ⇒  As every customs professional knows, goods must be classed according to the HTS to be imported or exported from the United States. Therefore, customs experts should be informed that the Harmonised System Update (HSU) 2403, which was established on February 13, 2024, comprises 590 ABI records and 120 harmonised tariff data. Their customs classification could be affected, and updating internal corporate computer systems would be necessary. A number of PGA HTS flag changes and modifications are included in HSU 2403 and are necessary for confirming the 2024 Harmonised Tariff Schedule (HTS). Please ensure that your classification computer system is up-to-date. Details here.

Why it matters ⇒ The U.S. Database on customs classification decisions, known as CROSS, is a valuable resource for customs professionals to assist in product classification. This tool is regularly updated, with the latest update on Feb 16, 2024, at 8:45 AM. It now contains a total of 213897 searchable rulings. The latest ruling was issued on February 12, 2024.  See here

European Parliament proposes new UCC amendments.

Why it matters ⇒ The EU has embarked on a major reform of customs legislation. The Committee on International Trade of the European Parliament has now endorsed amendments to the draft Union Customs Code. Customs professionals must study these to understand the future laws applying to customs in the EU. The IMTA committee argues that the Union Customs Code must be revised to achieve EU goals for people's welfare, sustainable societies, and trade prosperity. The proposed revisions seek to increase consistency between the updated Code and other laws, establish particular restrictions and requirements, and secure the EU border at all access points.The modifications address the fast evolution of global trade patterns, technology, business models, and stakeholder requirements, including citizens, consumers, and enterprises. The revisions also suggest revising the Customs Code to reflect the significant expansion of EU imports and exports, totalling 4 trillion EUR in 2019. In its view, the Committee says that the EU Customs Union (EU) should simplify and reform its goods movement regulations. Modern electronic service, the European Union Customs Data Hub, shall gather, process, and share customs law implementation data. Safety, security, accessibility, sustainability, human rights, and environmental preservation should be prioritised by customs. New technologies like the Digital Product Passport should assure compliance with these objectives.The amendments includes the establishment of a new Customs Advisory Board (CAB), for example.

Call to renew the multilateral Moratorium on Customs Duties on Electronic Transmissions

Why it matters ⇒ We should all come together in customs and global trade to support the Global Data Alliance's call for the US negotiator at WTO MC13 to extend the World Trade Organization's (WTO) multilateral Moratorium on Customs Duties on Electronic Transmissions. Most WTO members, including developing countries, favour renewing it. Nevertheless, a minority of WTO members is poised to obstruct the renewal process. I support the Alliance's view that ending the moratorium could hinder the elimination of discriminatory digital services taxes and lead to uncertainty in the global tax and trade landscape. Charging a customs duty on email attachments? That's quite amusing! Don't even think about it, for real!



Report on the WTO E-Commerce Tariff Moratorium

Why it matters ⇒ The Progressive Policy Institute has published a report highlighting the importance of the WTO E-Commerce Tariff Moratorium at 25. The report highlights the challenges MSMEs face, such as finding overseas customers, navigating customs documentation, securing payment, and managing returns. The report also highlights the growth of small exporting businesses in the United States, which has seen a decrease from an Obama-era peak of 281,000. The report also highlights the potential negative impact of customs duties on small firms and creative innovators, as well as the Internet's capacity to create new industries and employment categories. The report also highlights the potential damage to developing countries seeking additional tariff revenue, such as health services and education, by imposing new taxes on overseas nationals.

Staying Up-to-Date with the Latest US Customs Decisions and Bulletins


Why it matters ⇒ Every important classification developments and legal actions are described in the U.S. Customs Decisions and Bulletin, which comes out every week. Customs Professionals and layers, espeically in the U.S. will find this to be an important read. For example, this week, amongst amyn other issues discussed, U.S. Customs and Border Protection (CBP) has revoked of five ruling letters related to the tariff classification of human tissue samples, human fecal specimens, extracted human teeth, human urine specimens, and other human bodily specimens not prepared for therapeutic or prophylactic uses under the Harmonized Tariff Schedule of the United States (HTSUS). The rulings were based on a review of comments received and found to be in error. In other updated, the US Anti-Doping Agency is considering classifying these samples for in vitro laboratory research, which are used to study cancer development and proliferation. The terms "therapeutic" and "prophylactic" are not defined in the HTSUS or ENs, and their correct meaning is their common and commercial meaning. Here is more to discover, so have a look at it.

FDA Posts Document Related to Electronic Nicotine Delivery System (ENDS) Products for Importers

Why it matters ⇒  The U.S. Food and Drug Administration (FDA) has posted a user-friendly document to provide information needed for successful filing of Electronic Nicotine Delivery Systems (ENDS) products. ENDS products offered for import into the U.S. that meet the definition of a tobacco product are regulated by the FDA. In order to avoid delay of FDA admissibility determination, importers should provide the indicated information needed to their customs broker. ENDS products differing in any characteristic (including brand name, flavor, etc.) must be declared on separate lines in an entry filed via ACE. Why it matters ⇒  Following Brexit, importing and exporting goods into the UK may be difficult. Why it matters ⇒  The C2001 CDS form is used to apply for a voluntary clearance amendment (underpayment). It has now been updated. The C2001 is a voluntary disclosure tool for underpayments on import of goods, resulting in a charge (C18) for extra duty or VAT. Why it matters ⇒ The EU wants to open negotiations with the Republic of Colombia for a Partnership and Cooperation Agreement. Columbia is an important trading partner to the EU, and an FTA could bring with it zero customs duties and simplified procedures for EU businesses. Read details. 


EU's guidelines for complaints of non-compliance with FTAs

Why it matters ⇒ The European Commission's Single Entry Point is a centralised contact point for EU-based stakeholders seeking complaints about trade barriers or non-compliance with sustainability commitments in third countries. Complainants can submit complaints related to areas covered by EU trade agreements, such as market access, TSD, or GSP. Complainants can be single or multiple complainants, and must disclose their identities and the scope of the information required in the complaint forms. The Windsor Framework "Revised"

The UK Government has announced a "deal" to restore the devolved Northern Ireland Assembly and Executive, which have not been fully functioning since February 2022. The deal was published in a Command Paper titled 'Safeguarding the Union'.


Two statutory instruments (SIs) were also published to implement the proposals:

  • the Windsor Framework (Constitutional Status of Northern Ireland) Regulations 2024 and the Windsor Framework (UK Internal Market and Unfettered Access) Regulations 2024.


The government also published a draft SI for consultation, which would extend rules requiring certain goods sold in Northern Ireland to carry a 'not-for-EU' label to Great Britain.


Other proposals in the Command Paper, such as the proposed 'UK Internal Market Lane' for goods entering Northern Ireland from Great Britain, will require further legislation.

WCO publishes important Customs Classification Session documents

Why it matters ⇒ This latest HS session decided to extend the review cycle formally until 2028, allowing time for writing and decisions on the next edition. The new Harmonised System will now take effect on January 1, 2028, due to the pandemic's impact on the negotiating cycle. Furthermore, the committee approved 9 HS2028 Nomenclature adjustments, 3 HS2022 amendments, 20 new Classification Opinions, and 36 new classification judgments (see above Classification). DG Okonjo-Iweala on MC13: “We are going to get it done”

Speaking at a special meeting of the WTO’s General Council on 14 February, WTO Director-General Ngozi Okonjo-Iweala acknowledged the challenges members face in securing a package of outcomes for the organization’s upcoming 13th Ministerial Conference (MC13) in Abu Dhabi but said she was confident members would be able to deliver.  New edition of “WTO Ministerial Conferences: Key Outcomes” publication now available

A new edition of the “WTO Ministerial Conferences: Key Outcomes” publication is now available. This updated version contains all the key outcomes from WTO Ministerial Conferences since the organization was established in 1995, including for the first time the outcomes of the 12th Ministerial Conference (MC12) held in Geneva in 2022.

 

DDG Ellard stresses importance of securing substantive outcomes at MC13

Deputy Director-General Angela Ellard on 12 February outlined priorities for the WTO’s 13th Ministerial Conference (MC13) at the 2024 Washington International Trade Conference, organized by the Washington International Trade Association (WITA). In particular, she stressed the importance of securing the entry into force of the Agreement on Fisheries Subsidies and concluding the second wave of fish subsidy negotiations, securing progress on dispute settlement reform, and taking a decision on extending the existing e-commerce moratorium. Indonesia initiates WTO dispute complaint against EU duties on imports of fatty acids

Indonesia has requested WTO dispute consultations with the European Union regarding the EU’s imposition of definitive anti-dumping duties on imports of fatty acids from Indonesia. The request was circulated to WTO members on 12 February. Link to the details

In the course of the Ministerial Meeting, Customs Manager Ltd. will offer online sessions for daily updates. 13th WTO Ministerial Conference

The WTO's 13th Ministerial Conference (MC13) will take place from 26 to 29 February 2024 in Abu Dhabi, United Arab Emirates. Ministers from across the world will attend to review the functioning of the multilateral trading system and to take action on the future work of the WTO.
