What are general licenses and how do they function within UK sanctions frameworks?

General licenses represent a powerful compliance tool within the UK sanctions framework, permitting multiple parties to conduct activities that would otherwise be prohibited by sanctions legislation without requiring individual specific licenses. Issued by OFSI on behalf of HMT, these licenses offer a streamlined approach to addressing common scenarios where sanctions flexibility serves legitimate policy objectives.

Unlike specific licenses, general licenses are not issued upon application but are created proactively by OFSI in response to identified needs or unforeseen circumstances. They typically emerge when the government recognizes that permitting certain restricted activities aligns with broader policy priorities without undermining sanctions objectives. For example, a general license might be created to ensure critical financial services policies aren't inadvertently hindered by sanctions provisions.

Importantly, general licenses operate outside the confines of standard derogations listed in sanctions legislation (except for UN sanctions regimes), giving OFSI flexibility to address emerging challenges. This extends even to counter-terrorism regimes, where general licenses can provide carefully controlled exceptions.
