EU Customs Valuation: Simplification under UCC

The European Commission has issued fresh guidelines concerning the application of the valuation simplification scheme, as outlined in Articles 73 and 71 of the Union Customs Code (UCC) and Union Customs Code - Delegated Act (UCC-DA) respectively.
These guidelines offer detailed insights into several key aspects of the simplification scheme, including its eligibility criteria, the role of customs representation within its framework, administrative procedures, and consultation protocols during decision-making phases.
License fees and quality control costs have been cited as suitable examples illustrating the scheme's applicability.
However, it's important to note that the guidance does not address the issue of transfer pricing and its relevance to the scheme's implementation, despite its application in certain Member States.
Upon closer examination, several notable observations have emerged, particularly concerning the fulfilment of conditions:
The conditions for applying the simplification scheme serve as an alternative to the supplementary declaration scheme, specifically in cases where the latter incurs disproportionately high administrative costs. Examples of such costs may include the preparation of supplementary information, submission of supplementary declarations, and the allocation of adjustments.
A critical condition stipulates that provisional and final values should exhibit minimal discrepancy, substantiated by auditable data sources such as historical data and commercial documents.
Applicants are required to demonstrate a clean track record with customs, indicative of a robust accounting system. Holders of Authorized Economic Operator (AEO) status are exempt from this assessment.
Applicants must propose a calculation formula/methodology for calculating the customs value, substantiated by commercial documents, historical customs declaration data, and normal freight tariff rates. The determined value must be definitive to ensure no future adjustments that may affect the Union's budget.
