A successful Veterinary Border Conference: Watch On Demand!

This edition includes a wide range of updates, such as the new UK strategy on critical mineral imports and changes to CDS and the UK trade tariff. The UK Cabinet Office has issued a new bulletin, and HMRC has provided information regarding the removal of the CDS waiver code 999L. You can download these documents here and stay up to date. The UK has also increased the maximum threshold for making a simplified baggage goods declaration to £2,500. Don't forget the new rules for Northern Ireland (details in the update). Goods moving from Northern Ireland to Great Britain via Irish ports must also go through import procedures if they are non-qualifying Northern Ireland goods, excise goods, or goods that do not proceed directly to an Irish port after leaving Northern Ireland.
CBAM, CBAM, CBAM—the first report is coming up in less than two weeks. Have you submitted yours? If not, now is the time to do so. MEPs have raised some interesting questions to the EU Commission about a potential delay. View the EU's response. The EU has issued several classification decisions and updated its explanatory notes for the EU Trade Tariff. The implementation of various EU FTAs has continued, and a comprehensive update on all EU FTAs is now available for download. However, DG TAXUD tweeted about "ICS 2 Phase 3" last week, so we updated our guide, and you can now read everything about ICS 2 Phase 3 and download factsheets and help sheets to help you understand what it is and how to prepare for June 3, 2023. Please take note of the updated rules of origin for the EU-Bosnia and Herzegovina Free Trade Agreement.
The United States is preparing for the 2024 Trade Facilitation and Cargo Security (TFCS) Summit, which will be held on March 26-28, and has published another "US Customs Decisions and Bulletins". Please review all the changes, including the latest CBP recruitment drive.
The WCO and the WTO have released important news. The WCO has launched a review to overhaul the HS system, which is an important report to read. They are also recruiting for the PSCG, so make sure your global trade association is eligible to apply. Finally, the WTO is preparing for MC13 by reviewing the agenda items.

CBP confirmed its EAPA decision of evasion against wooden bedroom furniture from the People's Republic of China.
Tin Mill Goods
Commerce issued final antidumping duty rulings on tin mill goods from many trading partners, as well as a final countervailing duty finding for tin mill products from the People's Republic of China. The agency determined that tin mill commodities imported from Canada, China, Germany, and the Republic of Korea are dumped in the US market, while Chinese imports are also subsidised.

The first CBAM report is due on 31 January 2024
An updated provisional list of National Competent Authorities (NCAs) for the Carbon Border Adjustment Mechanism (CBAM) as of 09 January 2024 has been published. There is udpated CBAM - Information for importers of "cement"; "electricity"; "fertilisers" and on "aluminium" as of 03 January 2024, which is also available in all EU languages. Finally, the CBAM - Checklist for EU importers has been updated as of 03 January 2024.

EU TARIC updates
The EU TARIC gets updated multiple times a week, The changes should be reviewed by the customs manager to ensure that their businesses are not affected. IT content providers also require this data for their customs management solutions. The TARIC is an extensive database that consolidates all the necessary information on EU customs tariffs, commercial, and agricultural legislation. The updates are provided in Excel form, too.
Updates to Heading in the EU Explanatory Notes of the EU Tariff
Explanatory Notes to the Combined Nomenclature of the European Union (Heading 0206. "On page 20, in the Explanatory note to heading ‘ 0206 Edible offal of bovine animals, swine, sheep, goats, horses, asses, mules or hinnies, fresh, chilled or frozen ’, the following second paragraph is inserted: ‘This heading also includes animal bones normally used for making soups or broths for human consumption. These bones may have attached small (minor) residual pieces of meat, tendons, fat or cartilage remaining after removing the bones from meat of this chapter.’."
Changes to the explanatory notes of CN 2306 90 11 & 2306 90 19 On page 107, in the Explanatory note to CN subheadings ‘ 2306 90 11 and 2306 90 19 Oilcake and other residues resulting from the extraction of olive oil ’, the second paragraph is replaced by the following:
‘For the determination of the fat content, the method set out in Annex IV to Commission Implementing Regulation (EU) 2022/2105 (*1) is to be applied.

2024 U.S. Customs Regulatory Agenda
The semiannual regulatory agendas of the Departments of Homeland Security and Treasury include a number of regulations that have an impact on international trade. These regulations include a new procedure for entering low-value shipments, a final rule that requires customs brokers to verify the identities of importers and non-resident importers, and a proposed rule that requires export manifest data submission through ACE for rail cargo that is transported by rail.
ACE Entry Type 86
CBP alters some components of the ACE Entry Type 86 test to address "enforcement challenges" associated with low-value shipments included in the test. Some of the imports subjected to the Type 86 test included illegal drugs, counterfeit items, and commodities manufactured using forced labour. To solve these issues during the test, CBP will change the filing date for Entry Type 86 from "within 15 days" of the cargo's arrival to "upon or prior to arrival."
New Border Patrol Station
CBP has issued a supplementary environmental assessment for a new border patrol station in Orleans, New York. The planned project comprises the building of a new 49,000-square-foot facility to house existing and future workers, as well as the transfer of present activities from Wellesley Island.

CBP creates a new career webpage. US Customs and Border Protection (CBP) has launched a new careers website to improve recruitment and engagement for job seekers. The website features a dropdown feature, recruiter connections, chat bots, FAQs, and a simple survey. CBP is the largest law enforcement agency in the US. Detail here
Red Snapper Imports
CBP will now require red snapper imports to include the names and flags of all participating harvest boats, regardless of size. Until today, NOAA Fisheries' SIMP had a blanket exemption for reporting identifying information on small boats and farms. That exception was eliminated by a clause in the FY 2023 National Defence Authorization bill that set a one-year deadline for implementation.

The maximum threshold for making a simplified baggage goods declarations has increased to £2,500
Last week, in the UK, the maximum value barrier for generating simplified baggage goods declarations has increased to £2,500. Businesses who fulfil certain additional requirements and want to disclose items under £2,500 in total that they are taking out of the United Kingdom to sell or use for their company may find out how to do so here. This was put into law with notifications issued in accordance with the legally binding Customs (Export) (EU Exit) Regulations 2019 and the Customs (Import Duty) (EU Exit) Regulations 2018.
The sum mentioned in Notices issued under the Customs (Export) (EU Exit) Regulations 2019 has been revised to comply with Regulation 17A(3). Please see here

There is guidance on how to get a refund of VAT and import tax if you have overpaid, procedure C285. A section has been added that details what to do if you believe you could be eligible for a customs duty reimbursement after the Trade Remedies Authority has reviewed a case. Details here.

Customs Declaration Service: Document code ‘999L’ is being removed this month for imports
The UK government has announced that waiver document code '999L' will be permanently removed from import declarations after 31 January 2024. This code is used for ex-heading goods without documentary or licensing requirements. Instead, new national waiver document codes have been published to the UK Tariff, which should be used when submitting import declarations.

If you're submitting a customs clearance request or declaration, check for Customs Declaration Service known error solutions. This revised Consolidated Workaround Document (CWD) includes Inventory Linked Exports (ILE) v Customs Handling of Import and Export Freight (CHIEF) Known Differences modifications and a new inclusion in the ‘ILE v CHIEF Known Differences’ tab. Tariff Volume 3 Great Britain Supplement CDS and CHIEF has been updated
From 30 March 2024, the Customs Declaration Service (CDS) will be the UK’s single customs platform and all businesses will need to declare goods through the service. A change has been made to a supplement guide that businesses in the UK filing declarations should read. The guidance now clarifies that the temporary Buyer and Seller easement and the temporary extension in use of I1 B&E, which were due to expire, have been extended. Less than two weeks to go to NI Trade Changes
From 31 January 2024, some goods moving directly from Irish ports to Great Britain will face full customs controls. Traders and anyone moving goods on their behalf will need to be familiar with the new process. Goods moving from Northern Ireland to Great Britain through Irish ports will also have to complete import processes if they are non-qualifying Northern Ireland goods, excise goods, or goods that do not move directly to an Irish port once they have left Northern Ireland.

Tradecast: SOS for the SDGs: Why saving the development goals needs trillions of dollars in investment
This episode of The Weekly Tradecast looks at the importance of the Sustainable Development Goals (SDGs) and how much it will cost to achieve them with Nour Barnat, chief of methodology at UNCTAD Statistics. In 2015, UN members signed up to 17 SDGs that range from ending extreme poverty to tackling the climate crisis. The goals are supposed to be met by 2030 but most are off track because of the pandemic, economic turmoil and geopolitical tensions. It's estimated that the investment needed to hit the targets is around $6 trillion every year for the next seven years. That's equal to at least $750 per year for each person on the planet. Can we salvage the Sustainable Development Goals and where will the money come from? Reviewing the HS - New Interim Report
The World Trade Organization (WCO) has published an interim report on a possible strategic review of the Harmonized System (HS). The report affirms the HS as a crucial trade classification system with no superior alternative and acknowledges areas for improvement. The analysis consists of two sections: focusing on potential improvements to the HS, its tools, and procedural matters, and exploring strategies to respond to changing needs. Application open to join the Private Sector Consultative Group (PSCG)
The WCO Council established the Private Sector Consultative Group (PSCG) in 2005 to advise the WCO Secretary General, Policy Commission, and Members on Customs and international trade matters from the private sector's perspective. The PSCG consists of 28 members, predominantly businesses and associations, and has a three-year term. Members can be re-appointed after a three-year hiatus.
