A week in customs and global trade and so much going on! Let's review it together!
WIll EU steel safeguard measures are to be extended? That is the big question asked in the EU and global steel industry as the EU announced its review. On the "Prohibition & Restriction" front, the EU aims to become the first mercury-free economy, and a prohibition rule in on the way. Regarding FTAs and Rules of Origin, Niue is to become part of the EU – Pacific States FTA, too, and PEM convention alternative Rules of Origin can be applied to Ukraine and EU-Canada trde has been reviewed. As regards ESG, the EU presented a revised strategy for going carbon-neutral. In its new recommendations, the EU said that European industry must accelerate carbon capture, transport, and storage technologies to reduce emissions, enhance competitiveness, and ensure socially fair transitions, despite costly changes in certain sectors. We have the details in this update.
From the U.S. come the news that for the first time, the US did more trade with Mexico in 2023 than any nation previously, according to U.S. Census Bureau data, supassing Canada. This, plus the latest updates on Forced Labor Laws, a new Trade Snapshort and more in this update.
The UK has published important clarity on what is considered the origin for food products when imported to Great Britain.
As it is the Chinese e Lunar New Year, and the year of the dragon, I have the pleasure to share the 2024 Trade Facilitation Annual Report of China, recently released by Beijing Re-code Trade Security and Facilitation Research Center.

New EU ADD Guide
The European Commission has published an updated guide on 'How to make an anti-dumping complaint' to assist EU producers affected by dumped imports in preparing a complaint for an anti-dumping investigation. The guide aims to restore a level playing field in the EU market by allowing producers to submit a formal complaint containing evidence of dumping and resulting injury to EU industry. The guide is available in all European Union languages. It includes a structured format for companies to prepare complaints, links to information sources, forms for data provision, and step-by-step guidance for calculations.

EU TARIC updates
The EU TARIC gets updated multiple times a week, and The customs manager should review the changes to ensure that their businesses are not affected. IT content providers also require this data for their customs management solutions. The TARIC is an extensive database that consolidates all the necessary information on EU customs tariffs commercial and agricultural legislation. The updates are provided in Excel form, too.
Customs tariff number - important or unimportant?

The customs tariff number is something that causes headaches worldwide. The first 6 digits of the number are harmonized and should agree across countries.
There are now companies that are putting a lot of effort into this topic and putting a lot of resources and money into it. The customs data is then of good quality, but of course also comes at a price.
Other companies shy away from any effort on this topic and use 5 - 10 different customs tariff numbers for the entire product range. Most of the time the finished product has a number and the spare parts are classified as parts for.
I think many of you see yourself in one of the categories mentioned above. If it is the category "ONE", you can consider yourself lucky!! Is it even worth the effort to get into the “ONE” category?

Update to the Automated Export System Trade Interface Requirements – Appendix V – HTS Numbers that Cannot be Reported in AES
Update to the Automated Export System Trade Interface Requirements (AESTIR) – Appendix V – HTS Numbers that Cannot be Reported in AES has been posted to CBP.gov. At the request of the US Census Bureau, the HTS Numbers that Cannot be Reported in AES have been updated. Please contact the Census Call Center at 1-800-549-0595, Option 1, if you have any questions. Documentation is available under the ACE AESTIR, Appendix V on the AES webpage, which can be found here.
QB 24-113 USMCA Agriculture Canada
Commodities: Agricultural products are described in Chapter 98, Subchapter XXIII, U.S. Note 1 through US Note 10 of the Harmonized Tariff Schedule (HTS). This subchapter contains modifications of the provisions of the tariff schedule established under the provisions of the United States-Mexico-Canada Agreement. Goods entered under this subchapter and described in the provisions of this subchapter for which a rate of duty followed by a symbol in parentheses is herein provided are subject to duty at the rate provided in this subchapter instead of the rate therefore in chapters 1 through 97. 2024 Trade Facilitation and Cargo Security (TFCS) Summit

2024 Customs Broker Annual Permit User Fee Was Due on February 9, 2024

Trade News Snapshot - Volume 6, Issue 1
CBP has issued a new "Trade News Snapshot" and said they started the year with active engagement across critical areas: strengthening trade compliance, enhancing industry collaboration, and fostering innovation. "This issue offers a snapshot of those initiatives and our commitment to driving positive change and ensuring compliance across the board". Read it now.
CBP's Section 321 e-commerce initiative
CBP asked business leaders for CBP's Section 321 e-commerce data pilot and the Global Business Identifier initiative. Through these optional programmes, trade industry partners can provide import data that helps CBP identify shipments that pose a significant risk of breaking American trade laws and regulations.
CBP stopped counterfeit luxury goods and sunglasses worth over $1.2 million.
The San Juan Field Office of US Customs and Border Protection has intercepted and seized three shipments of counterfeit luxury goods and sunglasses worth over $1.2 million. The items were found in Chinese "Transparent Jewellery Box" cargo, containing 165 Van Cleef luxury jewellery pieces. The Hong Kong consignment also contained seven boxes of clothes, jewellery, shoes, and handbags. A third Chinese package included 240 Cartier, Louis Vuitton, and Versace, fake sunglasses with counterfeit logos. The San Juan Field Office has made 1,313 seizures worth over $21 million in the 2023 federal budget year. The agency advises consumers to be cautious and select authenticity when purchasing counterfeit items. Read more

Data Element 2/3 requires Documents and Other Reference Codes (Union) of the Customs Declaration Service concerning the need or the exemption from licences and certificates. These can be found in Appendix 5A and 5B. Now, document code A031 has been added for the Certificate of authenticity issued by Vietnamese authorities for quota number 054731. Download the spreadsheet of current codes to use now. The Appendix 5A National entry for 901Y has also been updated to reference further guidance within the main Import Declaration Completion Instructions for DE 2/3. Declaration Completion Instructions for DE 2/3 have been updated to guide the use of document code 901Y: This code should only be used to import goods from the EU exempt from pre-notification on PEACH or IPAFFS. EU Commission sets out how to sustainably capture, store, and use carbon to reach climate neutrality by 2050
The European Union (EU) is committed to achieving net zero CO2 emissions by 2050, focusing on technologies that can capture and store CO2 directly from the atmosphere. The Commission has adopted an Industrial Carbon Management Communication to outline how these technologies could contribute to reducing emissions by 90% by 2040 and reaching climate neutrality by 2050. The EU has proposed developing at least 50 million tonnes per year of CO2 storage capacity by 2030, which will need to grow to around 280 million tonnes by 2040. The Communication identifies actions at the EU and national levels to enable deploying these technologies and infrastructure to establish a single market for CO2 in Europe. The Commission will also establish guidance for project permitting processes, set up an atlas of potential storage sites, and develop an aggregation tool for matching CO2 suppliers with transport and storage operators.
Commission presents recommendation for 2040 emissions reduction target to set the path to climate neutrality in 2050
The European Commission recommends reducing greenhouse gas emissions by 90% by 2040 to reach climate neutrality by 2050. This follows the European Scientific Advisory Board on Climate Change (ESABCC) and EU Paris Agreement commitments. Enabling policy conditions include full 2030 framework implementation, European industry competitiveness, just transition, a level playing field with international partners, and strategic dialogue on the post-2030 framework. According to the Commission's impact assessment, global warming could reduce EU GDP by 7% by the end of the century. The energy sector is expected to decarbonise by 2040, focusing on zero and low-carbon solutions. Technology and carbon pricing should decarbonise transport. The agriculture sector can help the transition by producing enough food and paying fair wages. The EU will continue to create the proper framework for investment and production, with carbon pricing encouraging clean technology investments. Reducing emissions and removing carbon will help reach the 90% target.

CBP determines redesigned version of Apple Watches does not infringe asserted patent claims
On October 26, 2023, the US International Trade Commission (ITC) issued a limited exclusion order prohibiting certain Apple Watches that infringe the asserted patents from entering the United States. CBP is responsible for the enforcement of ITC exclusion orders. In administering that responsibility, CBP has determined that a redesigned version of the Apple Watches does not infringe any asserted patent claims. As of January 12, 2024, the redesigned versions ruled upon by CBP will be permitted to enter the United States.

CBP takes part in the EU campaign against forced labour
Eric Choy, Executive Director of Trade Remedy and Law Enforcement at the Office of Trade, participated in a virtual panel discussion on January 22 about forced labour and banning goods that violate human rights and fair competition laws in the European Union (EU). The European Union is attempting to conclude negotiations on a proposal that would outlaw forced labour. As part of that effort, the German Institute of Human Rights and the European Network of National Human Rights Institutions coordinate this dialogue. CBP will give an update on its enforcement efforts against forced labour and respond to inquiries from member states about how these prohibitions are being implemented.
House Committee hearing by Eric Choy on UFLPA enforcement
On January 11, Eric Choy, Office of Trade Executive Director, Trade Remedy and Law Enforcement, testified before the House Committee on Homeland Security Subcommittee on Oversight, Investigations, and Accountability on CBP's UFLPA enforcement. Two other government witnesses were DHS assistant secretary Christa Brzozowski and U.S. Department of Labour deputy undersecretary Thea Lee. Chairman Dan Bishop thanked the "exceptional panel of witnesses" for their preparation as the Subcommittee responded well to the hearing. Watch on YouTube

EU & Canada FTA: Progress Meeting Outcomes
The European Union and Canada have co-chaired the fourth Joint Committee of the Comprehensive Economic and Trade pact (CETA), underlining the advantages of the pact to respective economies. Two-way commerce in products and bilateral investment flows have expanded by over 50% since its tentative introduction in September 2017. CETA has helped diversify important industries and supply chains, especially after Russia's intervention against Ukraine. The Co-Chairs also announced progress on four key initiatives: a 'Interpretation on Investment', rules easing SMEs' access to investment dispute resolution, a CETA Mutual Recognition Agreement for architects' professional qualifications, and the GMP Protocol's operational scope extension.
CETA's Committees and Dialogues Co-Chairs applauded the Committee on Trade and Sustainable Development's significant involvement, emphasising carbon pricing and bilateral interaction. They also emphasised European and Canadian corporations' government procurement access improvements. They stressed the need of the Regulatory Cooperation Forum and reducing trade barriers. They also suggested strengthening EU-Canada economic collaboration in net-zero transition, economic security, and supply chain resilience.

UK- Moldova FTA
UK-Moldova strategic partnership, trade and cooperation agreement documents
UK and Ukraine: Tariff Free Trade
UK and Ukraine have extended tariff-free trade on most goods for an additional five years, extending the agreement to support Ukraine's long-term economic recovery from the war. The move is part of the UK's efforts to support Ukraine following Russia's full-scale invasion, which disrupted supply chains and transport routes. The UK was the first country to remove tariffs on all its trade with Ukraine two years ago. The extension will boost opportunities for Ukrainian businesses in key sectors such as oils, grains, and agri-foods. The UK will continue to support Ukraine's fight against Putin's invasion for as long as needed. Read the press release

USMCA: US trade with Mexico surpasses Canada for the first time
The U.S. did more trade with Mexico in 2023 than any nation previously, according to U.S. Census Bureau data. The U.S. trade deficit was $1.1 trillion, the third consecutive year above the $1 trillion mark. Port Laredo finished as the nation's top port for the first time based on its trade with Mexico, which replaced Canada as the nation's top trade partner after two years. The top U.S. export for the first time was oil, which replaced gasoline and other refined petroleum products. The top import was passenger vehicles, replacing oil. The U.S. did $798.83 billion in trade with Mexico in 2023, breaking the record set just last year with Canada. The top 10 U.S. trade partners were China, Germany, Japan, South Korea, the United Kingdom, Taiwan, Vietnam, and India. Port Laredo ranked on top for the first time, supplanting O'Hare, which had ranked first the previous two years. Read Article

UK: NCTS 5 Information Updated
The UK's New Computerised Transit System (NCTS) Phase 5 implementation date has been set for July 2024, allowing industry time to prepare. The new system offers improved functionality and is a legal requirement for all Common Transit Convention (CTC) member countries. Some new features will not be available until January 22, 2025. Users must start submitting transit declarations on NCTS5 from July 1, and software developers should prepare for NCTS5 by May 2024. Read about the update

UNCTAD (Global Trade Update)
New Report on Gaza
#Gaza: Unprecedented level of destruction will take tens of billions of dollars and decades to reverse.
According to an UNCTAD report released today, if the current military operation were to end immediately with reconstruction starting right away and the 2007-2022 growth trend persists with an average growth rate of 0.4 per cent, it would take Gaza until 2092 just to restore the GDP levels of 2022 with GDP per capita and socioeconomic conditions continuously declining.
However, even with the most optimistic scenario that GDP could grow at 10% annually it would still take Gaza’s GDP per capita until 2035 to pre blockade level of 2006.
The recovery of Gaza's economy from the current military operation will demand a financial commitment, several times the $3.9 billion that resulted from the 2014 military operation in Gaza and will involve a concerted international effort to restore pre-conflict socioeconomic conditions.

The UK has clarified information about the 'country of origin' in guidance for the IPAFFS notification. This is different from the customs customs of origin. For products that originated outside the EU or were last processed outside the EU and passed SPS import checks on entry to the EU, choose the non-EU country for your IPAFFS notification. Select the country where the product was last processed as the country of origin. For products that originated in the EU or were last processed in the EU, choose the EU country for your IPAFFS notification. The Basel Convention Environmental Network for Optimising Regulatory Compliance on Illegal Traffic in Waste (ENFORCE) and partners from the Green Customs Initiative met recently at the offices of the World Customs Organisation (WCO) to make environmental security stronger around the world. ENFORCE focuses on promoting compliance with the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal, while the Green Customs Initiative aims to empower Customs officers to monitor legal trade and detect illegal trade in environmentally sensitive commodities.
