A Message From the Editor: Happy New Year 2024


All,

Welcome to the first edition of "The Customs Manager," of 2024 - packed with updates and details that you need to know about customs. We hope you had a great start to the year.

A lot has changed over the last three weeks. So, what is in this edition?


The year has just begun, and we have tons of updates for you already. For a start, the customs tariffs were updated for the EU, the U.S. and the UK - see links below. Ian Saunders became Secretary General of the WCO among other changes.


But really, it is the finale that matters!


We are preparing for a "hot" end of January. The first CBAM report is due by 31 Jan (see extensive coverage below).


On 31 Jan, new UK veterinary rules are coming into force. Download below new documents published below and register for our conference on the 18th. And read our report on the UK CBAM, too.


Given that CBAM and Deforestation laws, Forced Labour and other environmental initiatives are only growing in importance, we are pleased to add a new column "Environmental, social, and Corporate Governance (ESG) into our blog-style magazine". Anti-Dumping Duty Updates

An anti-dumping duty is an extra import tariff imposed on top of the standard customs duty and applicable throughout a customs region. Its purpose is to enable countries to take action against the sale of goods at a price below their usual value, which is determined as the cost for similar goods sold in the exporter's domestic market. Anti-dumping duty on hot-rolled iron and steel products from Brazil, Iran, Russia, and Ukraine

Trade remedies notice 2023/20 is revoked with effect from 1 January 2024. From 1 January the anti-dumping duty payable on hot-rolled flat iron, non-alloy, or other alloy steel goods originating in Iran or Russia will be charged in line with Trade Remedies Notice 2023/16: Anti-dumping duty on certain hot-rolled flat products of iron, non-alloy or other alloy steel originating in Brazil, Iran, the Russian Federation and Ukraine. GUIDANCE: New Threshold for Deactivating Section 232 Exclusions

The Bureau of Industry and Security (BIS), within the Department of Commerce (DOC), grants exclusions to the Section 232 import duties and quotas on steel and aluminum imports. BIS allocates specific quantities of imports which can be imported under each exclusion. When imports under an exclusion reach the quantity limits of a Section 232 exclusion, that exclusion is no longer valid, and duties under the Section 232 measure apply. Read more

HTS and Schedule B updated

In preparation for the year 2024, both the Harmonised Tariff Schedule (HTS) and Schedule B have been revised. Both publications display a number of pages that include code modifications. One of the finest practices for importers and exporters is to review their codes on a yearly basis or more often. Make certain that you are not using outmoded codes in order to prevent delays at customs and the possibility of incurring fines. The URLs to the HTS and Schedule B are provided below. The UK Trade Tariff has been updated to state that UK import declarations should be made through the Customs Declaration Service, and from 30 March 2024 all export declarations should be made through the Customs Declaration Service. Read our guide to help you get ready


Changes to CDS - Latest Updates

Data Element 2/3: Document codes C091, L146, X841, X842, Y704, Y870, Y872, Y873, Y874, Y875, Y876, Y877, Y878, Y893, Y894 & Y895 have been added. Data Element 2/3: Document and Other Reference Codes: Licence Types – Imports and Exports of the Customs Declaration Service (CDS) - Document code L146 has been added to Appendix 5C Imports. Document codes X841 and X842 have been added to Appendix 5C Exports. Appendix 2: DE 1/11: Additional Procedure Codes of the Customs Declaration Service (CDS). Find out the completion rules instructions for each 3-digit Union and National Additional Procedure Code that can be used in Data Element (DE) 1/11 for Imports. References to ‘Volume 3’ and the contact details for the Tariff Classification team in Additional Procedure Code 1-Series (Appendix 2B) have been updated. No technical content has been altered.

  • Action brought Vossko vs. Commission filed Case T-1059/23 on November 3, 2023, to remove Implementing Regulation (EU) 2023/1629, the tariff rate limit, imports, ready-to-eat chicken meat from Brazil, and EU law breaches. The petitioner argues that Implementing Regulation (EU) 2023/1629 breaks Article 16 of the Charter of Fundamental Rights by making it harder for applicants to run their businesses freely. The higher limit affects the applicant's business, making it unnecessary and inappropriate. Additionally, Implementing Regulation (EU) 2023/1629 goes against Article 17 of the Charter, which grants application rights to property. The petitioner and Brazil's top cooked chicken meat makers are both affected by Regulation (EU) 2023/1629, which goes against the fairness and clarity of EU law. The regulation changes tariff rate limits without warning, violating the Court of Justice's fair expectations and legal clarity standards. The regulation lacks temporary or remedial measures, and putting it into effect from the past is against the law.

EU-Japan FTA: Amendment of Annex 14-B on geographical indications

Notice concerning the date of entry into force of the amendment to Annex 14-B of the Agreement between the European Union and Japan for an Economic Partnership

By means of its Decision No 2/2023, the Joint Committee established under the Agreement between the European Union and Japan for an Economic Partnership, signed in Tokyo on 17 July 2018, decided to amend Annex 14-B of the Agreement. The amendment entered into force on 22 December 2023.


Question on EU-Australia FTA

A French MEP has recently asked the EU Commission: "Based on the current state of negotiations and the Commission’s assessments, what impact would this free trade agreement have on the French agricultural sector once in force?".

Mr. Wojciechowski provided the European Commission's response (4.1.2024): "Negotiations for a Free Trade Agreement (FTA) between the EU and Australia are nearing completion. Despite unsuccessful attempts to reach a deal at the G7 conference in Osaka in late October 2023, the EU aims to reach a balanced agreement with Australia. This deal is a priority for the EU trade agenda, both economically and geopolitically. The EU considers the cumulative impact of concessions in FTAs, geopolitical challenges, Green Deal commitments, and UK agreements with Australia and New Zealand when negotiating. The Union agricultural market access offer must be financially viable while minimising negative impacts on sensitive industries like red meat, sugar, and dairy, which are of particular concern to France.

At the same time, the EU seeks answers for its own agricultural aggression. These include protecting Union geographical indications, addressing sanitary and phytosanitary market access difficulties, and improving access for agricultural goods, including as dairy".

Update on UK’s cheese exports to Canada

On January 1, 2024, the UK's access to Canada's cheese WTO quota was modified.

Canada provides two reserves for the WTO cheese quota: 14,272 tonnes are allotted to EU members, while 6,140 tonnes are allotted to non-EU sources. The Trade Continuity Agreement (TCA), which was agreed in 2021, let the UK to utilise the "EU member state reserve" in Canada's WTO cheese quota until December 31, 2023. Up until now, Canadian importers who have been given "EU reserve" import licences by the Canadian government to purchase certain quantities of cheese have been how UK cheese producers have shipped to Canada. The UK has switched from the "EU reserve" to the "non-EU sources reserve" under Canada's WTO cheese quota as of January 1, 2024. To ship cheese under Canada's WTO quota, UK exporters must confirm that their Canadian customer has obtained an import authorization under the "non-EU sources reserve" as of January 1, 2024. Without this, cheese shipments from the UK to Canada will be subject to full duties. See here

The U.S. President terminated its designation as a beneficiary sub-Saharan African country due to Mauritania's inability to meet the requirements of the Trade Act of 1974 and the African Growth and Opportunity Act. Details


Import Procedure Updates


New transparency rules come into force this 1 January that will help EU Member States to crack down on Value-Added Tax (VAT) fraud.

The new rules will provide tax administration of the EU Member States with payment information allowing them to detect VAT fraud more easily, with a particular focus on e-commerce which is particularly prone to VAT non-compliance and fraud. This in turn creates holes in the tax revenues that pay for vital public services. See details

English Sparkling Wine makers raise a glass to new opportunities

On the eve of New Year reforms for the wine industry, the UK is scrapping of rules inherited from the EU. Click here. Since 1 January 2024, makers of English Sparkling Wine will no longer have to use mushroom-shaped stoppers and foil covers on bottlenecks, giving producers the choice to opt for simpler packaging to reduce both waste and costs.

Restrictions will also be scrapped on the making and selling of piquette - a lower-alcohol drink dating back to antiquity, made by extracting the remaining goodness from grapes left over after winemaking. This gives producers the option to create new income streams and tap into consumer demand for lower-alcohol drinks.

MC13 Chair briefs members on ministerial preparations

At a 13-15 December meeting of the WTO’s General Council, members heard from the Chair of the 13th Ministerial Conference (MC13), H.E. Dr Thani bin Ahmed Al Zeyoudi, Minister of State for Foreign Trade of the United Arab Emirates, on preparations for MC13, which will take place in Abu Dhabi in February 2024. Members also approved a budget increase for the WTO Secretariat for the 2024/2025 biennium following 12 years of zero nominal growth.


DG Okonjo-Iweala: It’s time to “dramatize” Geneva to deliver concrete outcomes for MC13

In her report to a meeting of the WTO’s Trade Negotiations Committee (TNC) on 12 December, Director-General Ngozi Okonjo-Iweala said it was incumbent upon WTO members to deliver concrete outcomes at the upcoming 13th Ministerial Conference (MC13) in Abu Dhabi next February. To achieve this, negotiators “need to conclude as much of the negotiations we can in Geneva” before the start of MC13.
